Terms of service

Last updated: 15 October 2026

These Terms of Service ("Terms") govern your use of this website and every purchase you make from it. Please read them carefully before you place an order. By placing an order or creating an account, you agree to these Terms. If you do not agree, please do not use the website.

1. Who we are

1.1 This website is operated by Foppeun LLC, a limited liability company organized under the laws of the State of New Mexico, United States, with its business address at 120 Madeira Dr NE # 220, Albuquerque, NM 87108, United States ("Floga", "we", "us", "our"). Floga® and PlayPauseBe® are registered trade marks owned by or licensed to Foppeun LLC.

1.2 You can contact us at info@playpausebe.com. If we need to contact you, we will do so by email or by post, using the details you gave us with your order.

1.3 These Terms should be read together with our Privacy Policy, Shipping Policy, Return and Refund Policy and, for subscriptions, our Purchase Options Cancellation Policy. Together they form the agreement between you and us. If a policy and these Terms conflict, the more specific provision prevails.

2. Who may buy

2.1 You must be at least 18 years old, or the age of majority where you live if higher, to place an order. Younger users may use our products only with the involvement of a parent or guardian, who is responsible for the purchase.

2.2 Our website is intended for consumers buying for personal use. Yoga teachers and studios buying for their own classes are welcome. Wholesale and resale orders are governed by separate written terms, which we will provide on request; these Terms do not apply to them unless we agree otherwise in writing.

2.3 Where these Terms refer to a "consumer", they mean an individual acting wholly or mainly outside their trade, business, craft or profession. Some provisions apply differently depending on whether you are a consumer, and where you live.

3. Your account

3.1 You may need an account to access online courses or manage subscriptions. You are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly at info@playpausebe.com if you believe your account has been used without your permission.

3.2 The information you give us must be accurate and complete, and you must keep it up to date.

4. Our products

4.1 We sell physical products, such as the PlayPauseBe yoga card decks, and digital products, such as Floga Academy online courses, PDF guidebooks and issues of Floga Monthly (together, "Digital Products"). We may also offer bundles and packs that combine both.

4.2 We take care to describe and photograph our products accurately. Small differences in color between the screen and the printed product may occur, as may minor changes to packaging. Course descriptions, lesson counts and durations are given in good faith and may be updated as we improve a course, without reducing its overall content or quality.

4.3 Limited editions and limited print runs are available only while stocks last.

5. Prices, currencies and taxes

5.1 Prices are shown in euros, pounds sterling or US dollars, depending on the country you shop from. The price that applies is the price shown at checkout when you place your order.

5.2 Any applicable taxes and the shipping cost are displayed at checkout before you pay.

5.3 Import duties and local taxes for deliveries outside the United States, the United Kingdom and the European Union are explained in our Shipping Policy.

5.4 Despite our care, a product may occasionally be listed at an incorrect price. If the correct price is higher than the price shown, we will contact you before accepting your order, and you may confirm the order at the correct price or cancel it. If the error was obvious and you could reasonably have recognized it, we are not obliged to supply the product at the incorrect price, even after accepting the order, and we will refund any amount you paid.

6. Offers, discount codes and free items

6.1 Some offers apply automatically in the cart when your order meets their conditions, for example multi-deck discounts, free shipping thresholds, a discount on a second course or a free course. The conditions of each offer are shown on our website at the time of your order.

6.2 Discount codes cannot be combined with automatic offers or with other codes unless we expressly say so. Only one code may be used per order. Codes have no cash value, cannot be exchanged and may be withdrawn or changed at any time, without affecting orders already placed.

6.3 Free items are supplied only together with a qualifying order. If you return items from that order and it no longer meets the conditions of the offer, the provisions on offers in our Return and Refund Policy apply.

6.4 We may refuse to apply, or cancel, an offer or a code used in breach of its conditions, including where it was obtained or shared in a way we did not authorize, or where orders are split or repeated to exploit it.

7. How a contract is formed

7.1 Our product pages are an invitation to you to place an order; they are not a binding offer. When you place an order, you make an offer to buy.

7.2 After you place an order, we send you an email acknowledging that we have received it. That acknowledgement does not mean your order has been accepted.

7.3 A contract between you and us comes into existence when we accept your order, which happens: (a) for physical products, when we email you to confirm that your order has been dispatched; and (b) for Digital Products, when we make the product available to you or confirm access by email, whichever is earlier.

7.4 We may decline an order, for example if a product is out of stock, if we cannot deliver to your address, if there is an error in the price or description, if we cannot verify your payment, or if we reasonably suspect fraud or a breach of these Terms. If we decline your order, we will tell you and refund any amount taken.

8. Payment

8.1 Payment is taken in full at checkout using one of the methods displayed. Payments are processed by our payment providers; we do not see or store your full card details.

8.2 You confirm that you are authorized to use the payment method you provide.

8.3 Ownership of physical products passes to you when we have received full payment.

9. Canceling an order before dispatch

9.1 If you change your mind or made a mistake, contact us through the chat on our website or at info@playpausebe.com as soon as possible with your order number. If your order has not yet been picked and packed at our warehouse, we will cancel it and refund you in full. Orders are usually packed within 24 hours on business days, so please write promptly.

9.2 Once an order has been dispatched, it can no longer be canceled, but you can return it under our Return and Refund Policy.

10. Delivery

10.1 Delivery is governed by our Shipping Policy. Delivery times are estimates. If you are a consumer in the EU or the UK and we fail to deliver within the agreed time, or within 30 days of your order if no time was agreed, you may give us an additional reasonable period, after which you may end the contract and receive a full refund.

10.2 The risk of loss of or damage to physical products passes to you when the products are delivered to the address you gave us, or collected by you or by someone you nominated.

11. Your right to cancel and our money-back guarantee

11.1 Physical products come with a 15-day money-back guarantee from the day of delivery, and Floga Academy courses with a 30-day money-back guarantee from the day of purchase. Consumers in the EU and the UK also have a statutory right to withdraw from distance contracts. Both are explained in full, together with the exceptions for downloadable content, in our Return and Refund Policy.

12. Faulty products and your legal rights

12.1 We are under a legal duty to supply products that conform with the contract. If you are a consumer, you have legal rights in relation to products that are faulty or not as described. In the EU, you benefit from a legal guarantee of conformity of at least two years from delivery; in the UK, from the rights in the Consumer Rights Act 2015; in the United States, from any warranties implied by state law that cannot be excluded. Nothing in these Terms affects these rights.

12.2 If something is faulty, damaged or not what you ordered, please contact us as described in our Return and Refund Policy.

13. Digital Products

13.1 License. When you buy a Digital Product, we grant you a personal, non-exclusive, non-transferable and revocable license to access and use it for your own, non-commercial purposes, subject to these Terms. You do not acquire ownership of the content.

13.2 What you may not do. You may not share your login or let anyone else use your access; copy, download (except where we offer a download), record, reproduce, resell, sublicense, publish, broadcast or distribute any Digital Product or part of it; remove copyright or other notices; or use it to create a competing product or course.

13.3 Yoga teachers. If you teach yoga, you may use what you learn, and the PlayPauseBe decks you own, to plan and teach your own classes. You may not reproduce our course videos, written materials, guidebooks or card artwork in your classes, handouts, social media or other materials, except for brief, credited references.

13.4 Access. Access to a course starts as soon as your purchase is confirmed. "Lifetime access" means access for as long as we operate Floga Academy and offer the course. If we decide to stop offering a course, we will give you at least 90 days' notice by email, so you can complete it. We may update, reorganise or improve course content, provided the course as a whole remains materially as described when you bought it.

13.5 Technical requirements. Digital Products require an internet connection and a compatible, up-to-date device and browser. We are not responsible for failures caused by your device, software or connection.

13.6 Suspension. We may suspend or end your access to a Digital Product, without refund, if you materially breach this section 13, for example by sharing your account or redistributing our content. Where reasonable, we will first ask you to stop.

14. Yoga Alliance continuing education (YACEP)

14.1 Floga is a Yoga Alliance Continuing Education Provider (YACEP) and a Registered Yoga School (RYS 200). Certified versions of certain courses carry continuing education hours.

14.2 Continuing education hours and any certificate are awarded only when you have completed all the requirements of the certified version of the course, including any assessments or assignments. Certificates are personal and non-transferable.

14.3 Registration with Yoga Alliance, the logging and acceptance of continuing education hours and the requirements for maintaining a registration are governed by Yoga Alliance's own rules. We are not responsible for Yoga Alliance's decisions or for changes to its requirements.

14.4 Once a certificate has been issued for a course, the course counts as completed and is no longer eligible for a refund under our money-back guarantee.

15. Subscriptions

15.1 Some products may be offered as subscriptions that renew automatically. The price, billing period, renewal and cancellation terms of each subscription are shown before you buy and are set out in our Purchase Options Cancellation Policy.

15.2 The Floga app is governed by its own terms of use, which you accept in the app. Subscriptions bought through the App Store or Google Play are sold and billed by Apple or Google under their terms.

16. Your health and safety

16.1 Yoga, breathwork and the other practices in our products involve physical and mental activity. Our decks, courses, guidebooks, magazine and other content are provided for general educational purposes only. They are not medical advice, diagnosis or treatment and do not replace advice from a doctor or other qualified health professional.

16.2 Before you begin any practice, and particularly if you are pregnant, have recently given birth, are injured, have a medical condition or take medication, consult a qualified health professional. Practice within your own limits, use the modifications offered, and stop immediately if you feel pain, dizziness or discomfort.

16.3 You are responsible for practicing in a safe space, with suitable equipment, and for choosing practices appropriate to your health and experience. If you teach, you are responsible for the safety of your own students.

17. Intellectual property

17.1 All content on this website and in our products, including illustrations, card designs, texts, course videos, audio, photographs, logos and software, is owned by Foppeun LLC or by our licensors and is protected by copyright, trade mark and other intellectual property laws worldwide. All rights are reserved.

17.2 Floga® and PlayPauseBe® are registered trade marks owned by or licensed to Foppeun LLC. These marks, our logos and our other brand names, product names and get-up may not be used, in whole or in part, in any domain name, business name, product, social media account, advertising keyword or other material, nor in any way likely to cause confusion or suggest an association with us, without our prior written consent. We actively protect our trade marks and other intellectual property rights.

17.3 Except as expressly allowed in these Terms, you may not copy, reproduce, adapt, distribute, publicly display or commercially exploit any of our content.

17.4 If you believe that content on our website infringes your copyright, email info@playpausebe.com with the subject "Copyright notice", including: identification of the work and of the material you believe infringes it, with its location on our website; your contact details; a statement that you have a good-faith belief that the use is not authorized by the owner, its agent or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf; and your physical or electronic signature. This procedure follows the US Digital Millennium Copyright Act (17 U.S.C. § 512).

18. Acceptable use

18.1 You may use our website only for lawful purposes. You must not: break any applicable law; infringe the rights of others; impersonate any person; send unsolicited advertising; introduce viruses or other harmful material; attempt to gain unauthorized access to our website, servers or accounts; use robots, scrapers or other automated means to access or copy the website or its content; interfere with the website's operation, including by denial-of-service attacks; or post false reviews or otherwise manipulate ratings.

19. Reviews, feedback and content you send us

19.1 If you send us a review, photo, testimonial or other content, you confirm that it is your own, honest and lawful, and you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, adapt and publish it, with your first name or initials, on our website, in our communications and in our advertising. We may edit content for length or clarity without changing its meaning, and we may decline or remove content that is unlawful, offensive, misleading or unrelated to our products.

19.2 If you send us ideas or suggestions, we may use them freely and without obligation to you.

20. Third-party websites and services

20.1 Our website may link to, or embed content from, third-party websites and services, such as video platforms, payment providers and social networks. We do not control them and are not responsible for their content, policies or practices.

21. Our liability to you

21.1 What we do not exclude. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

21.2 If you are a consumer in the EU or the UK. We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or of our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when the contract was made, both we and you knew it might happen. We are not responsible for loss or damage that is not foreseeable. We supply our products for domestic and private use only; we are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.

21.3 For all other customers, to the fullest extent permitted by law: (a) the website and Digital Products are provided "as is" and "as available", and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement, except those that cannot be disclaimed; (b) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill; and (c) our total liability arising out of or in connection with any order is limited to the amount you paid for that order.

21.4 We are not liable for any injury, loss or damage arising from a practice you undertake, except to the extent caused by our negligence or breach of these Terms, and subject always to section 21.1.

22. Events outside our control

22.1 We are not liable for any delay or failure to perform caused by events beyond our reasonable control, such as natural disasters, epidemics, war, strikes, failures of carriers, warehouses, payment systems or internet services, or acts of government. If such an event occurs, we will tell you as soon as reasonably possible and take reasonable steps to minimize the delay. If the delay is substantial, you may cancel your order and receive a refund for any products you have paid for but not received.

23. Applicable law and disputes

23.1 Let us try to help first. If you have a complaint, please email info@playpausebe.com. We aim to reply within 5 business days and to resolve complaints promptly and fairly.

23.2 Governing law. These Terms and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules.

23.3 Courts. Subject to section 23.4, the state and federal courts located in Bernalillo County, New Mexico, have exclusive jurisdiction. You may also bring a claim in a small-claims court where you live, if it has jurisdiction.

23.4 Consumers outside the United States. If you are a consumer living in the European Union, the United Kingdom or another country with mandatory consumer protection laws, the choice of New Mexico law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your country of residence. If you live in the EU, you may also use the alternative dispute resolution bodies available in your country.

23.5 The United Nations Convention on Contracts for the International Sale of Goods does not apply.

24. General

24.1 Changes to these Terms. We may amend these Terms from time to time, for example to reflect changes in the law or in our products. The version published on this page when you place an order applies to that order. Changes to subscription terms are notified as described in our Purchase Options Cancellation Policy.

24.2 Transfer. We may transfer our rights and obligations under these Terms to another organization, for example in the event of a sale of our business, provided this does not reduce your rights. You may not transfer your rights or obligations without our written consent.

24.3 Severability. If a court or authority finds any provision of these Terms invalid or unenforceable, the remaining provisions remain in full force, and the affected provision applies to the maximum extent permitted.

24.4 No waiver. If we do not insist immediately on your performing any obligation, or delay taking steps against you, that does not mean we have waived our rights.

24.5 Third parties. These Terms are between you and us. No other person has any right to enforce them.

24.6 Entire agreement. These Terms and the policies referred to in them form the entire agreement between you and us regarding your use of the website and your orders.

24.7 Language. These Terms are written in English. If we provide a translation, the English version prevails to the extent permitted by law.
