Privacy policy

Last updated: 15 October 2026

This Privacy Policy explains how Foppeun LLC collects, uses, shares and protects your personal data when you visit this website, buy from us, take a Floga Academy course, subscribe to our emails or otherwise contact us, and the rights you have. Please read it together with our Terms of Service.

1. Who is responsible for your data

1.1 The controller of your personal data is Foppeun LLC, a limited liability company organized under the laws of the State of New Mexico, United States, trading as Floga ("we", "us", "our"), 120 Madeira Dr NE # 220, Albuquerque, NM 87108, United States. Floga® and PlayPauseBe® are our brands.

1.2 For any privacy question or request, email info@playpausebe.com with the subject "Privacy".

2. The personal data we collect

  • Identity and contact data: name, email address, billing and delivery address, phone number.
  • Order and transaction data: products bought, prices, discounts, order history, returns and refunds, and payment confirmation. Card details are processed by our payment providers; we never see or store your full card number.
  • Account and course data: login details, course enrollments and progress, assignments you submit, and continuing education certificates issued to you.
  • Communications: messages you send us, survey answers, reviews and the information you give us when you join a waitlist or newsletter, such as your yoga experience level.
  • Marketing preferences: whether you have agreed to receive our emails, and how you interact with them (for example, opens and clicks).
  • Technical and usage data: IP address, device and browser type, approximate location derived from your IP address, pages viewed, items added to your cart, and referral source, collected through cookies and similar technologies (see section 6).

We do not intentionally collect special categories of data, such as health data. If you choose to tell us about an injury or health condition, for example when asking which course suits you, we use it only to answer you and delete it when it is no longer needed.

3. How we collect it

  • From you, when you place an order, create an account, take a course, sign up for emails or a waitlist, write a review or contact us.
  • Automatically, through cookies and similar technologies when you use our website, subject to your consent where the law requires it.
  • From service providers and partners, such as our payment providers (for fraud checks and payment confirmation), our logistics partners and carriers (delivery status), and advertising platforms (aggregated campaign results).

4. Why we use your data, and our legal bases

Where the EU or UK GDPR applies, we rely on the following legal bases:

  • To process and deliver your orders, give you access to courses and subscriptions, handle returns and refunds and provide customer service: performance of our contract with you.
  • To keep accounting and tax records, issue invoices and respond to lawful requests: compliance with legal obligations.
  • To prevent fraud and misuse, secure our website and accounts, and enforce our terms: our legitimate interests in protecting our business and customers.
  • To improve our website, products and courses, using analytics and feedback: our legitimate interests, and your consent where cookies are involved.
  • To send you marketing emails: your consent; or, where the law allows, our legitimate interest in telling existing customers about similar products, with a simple way to opt out in every email.
  • To show you personalized advertising and measure its effectiveness: your consent.
  • To publish your review or testimonial: your consent.

Where we rely on legitimate interests, we have weighed them against your rights; you may ask us for details. Where we rely on consent, you may withdraw it at any time, without affecting processing that took place before. If you do not provide the data we need to fulfill an order, we will not be able to complete it.

5. Marketing

We send marketing emails only where you have agreed or where the law otherwise allows it. You can unsubscribe at any time using the link in every email or by writing to us. We will still send you service messages about your orders, courses and account.

6. Cookies and similar technologies

6.1 We use cookies and similar technologies that are strictly necessary for the website and checkout to work, for example to keep your cart and protect forms against spam. These do not require consent.

6.2 With your consent, where required, we also use analytics cookies to understand how our website is used, and marketing cookies and pixels, including those of Meta and Google, to measure and personalize advertising.

6.3 Where the law requires it, you will see a cookie banner on your first visit, and you can change your choices at any time through the privacy settings link in the website footer. You can also block or delete cookies in your browser settings, although parts of the website may then not work as intended.

6.4 Videos embedded from third-party platforms, such as YouTube or Vimeo, may set their own cookies when you play them.

7. Who we share your data with

We do not sell your personal data for money. We share it only as necessary with:

  • Shopify, which hosts our store and processes data on our behalf (see section 8);
  • payment providers, such as Shopify Payments and its partner Stripe, and, where offered, PayPal, which act as independent controllers for some processing, such as fraud prevention and regulatory compliance;
  • logistics partners and carriers in the United States, the United Kingdom and the Netherlands, which receive your name, delivery address, phone number, email and order details to pack and deliver your order;
  • providers who help us run our business, such as our online course platform, email marketing and customer service tools, cloud storage, anti-spam protection (hCaptcha) and video hosting;
  • the Floga app, if you buy an app subscription on this website: we share your email address and subscription status with the app's subscription management provider so we can activate your access;
  • advertising and analytics partners, such as Meta and Google, where you have consented;
  • professional advisers, such as accountants, auditors and lawyers;
  • authorities, where required by law or to protect our rights, our customers or others; and
  • a buyer or successor, if all or part of our business or assets is sold, merged or transferred, in which case your data will remain protected under the terms of this policy.

Our service providers may use your data only on our instructions and must keep it secure and confidential.

8. Our relationship with Shopify

Our store is hosted by Shopify, which processes personal data about your use of the store to provide and improve its services to us. To help protect, grow and improve our business, we use certain Shopify enhanced features that combine data about your interactions with our store, with other merchants and with Shopify. For these features, Shopify is responsible for the processing of your personal data, including for responding to your requests to exercise your rights. You can learn more in the Shopify Consumer Privacy Policy and exercise certain rights through the Shopify Privacy Portal.

9. International transfers

We are based in the United States, and our providers process data in the United States, the United Kingdom, the European Economic Area and other countries. When we transfer personal data from the EEA, the UK or Switzerland to a country that has not been recognized as providing an adequate level of protection, we rely on an appropriate safeguard, such as the European Commission's Standard Contractual Clauses with the UK International Data Transfer Addendum, or the recipient's certification under the EU-US Data Privacy Framework and its UK and Swiss extensions. You may ask us for a copy of the relevant safeguards.

10. How long we keep your data

  • Order, invoice and tax records: for as long as tax and accounting laws require, generally up to 10 years after the order.
  • Account and course data: while your account or access is active, and up to 3 years after your last activity, unless you ask us to delete it sooner.
  • Continuing education records: for as long as needed to verify certificates we have issued, generally up to 5 years.
  • Customer service correspondence: up to 3 years after the matter is closed.
  • Marketing data: until you unsubscribe or withdraw consent; we then keep your email address on a suppression list so we do not contact you again.
  • Cookies: for the periods shown in our cookie settings.

We may keep data longer where needed to establish, exercise or defend legal claims.

11. Security

We use appropriate technical and organisational measures to protect your personal data, including encryption in transit, access controls and the security of our established providers. No system is completely secure; if a breach affects your data, we will notify you and the authorities where the law requires.

12. Your rights

12.1 Depending on where you live, you may have the right to: access your personal data and receive a copy; correct inaccurate data; delete your data; restrict or object to our processing, including at any time to direct marketing and to processing based on legitimate interests; receive your data in a portable format; withdraw consent; and not be subject to decisions based solely on automated processing that produce legal or similarly significant effects. We do not make such decisions, although our payment providers use automated tools to detect fraudulent payments.

12.2 To exercise your rights, email info@playpausebe.com. We may need to verify your identity. We respond within one month, which may be extended by two further months for complex requests, in which case we will tell you. Exercising your rights is free, unless a request is manifestly unfounded or excessive.

12.3 You may authorize an agent to make a request on your behalf; we will ask for proof of authorisation and may need to verify your identity directly with you.

13. Additional information for residents of US states

13.1 Residents of California and other US states with consumer privacy laws may have the right to know what personal information we collect, use and disclose; to access, correct and delete it; to opt out of the "sale" or "sharing" of personal information and of targeted advertising; and to appeal our decision on a request.

13.2 We do not sell personal information for money. Our use of advertising cookies and pixels may be considered "sharing" for cross-context behavioural advertising or "targeted advertising". You can opt out at any time on our data sharing opt-out page. We honor Global Privacy Control signals as a valid opt-out request for the browser or device that sends them.

13.3 We do not knowingly sell or share the personal information of consumers under 16. We do not use or disclose sensitive personal information for purposes that would give rise to a right to limit its use.

13.4 If we deny your request, you may appeal by replying to our decision with the subject "Privacy appeal". If you remain unsatisfied, you may contact your state Attorney General. We will not discriminate against you for exercising your rights.

14. Children

Our website and products are not directed at children under 16, and we do not knowingly collect their personal data. If you believe a child has given us personal data, please contact us and we will delete it.

15. Complaints

If you have a concern, please contact us first, and we will do our best to resolve it. You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the country where you live or work or where an alleged infringement took place. In the EU, you can find your authority on the European Data Protection Board website; in the UK, it is the Information Commissioner's Office.

16. Changes to this policy

We may update this Privacy Policy from time to time. We will post the new version on this page with a new "Last updated" date and, where the changes are significant, we will notify you by email or through the website.
